The Code of Virginia provides definitions of private and public streets in Virginia. A “private street” is a subdivision street that has not been dedicated to public use or that requires the permission or invitation of a resident or owner to use the street. Such streets are not intended to be included in the secondary state system of highways maintained by VDOT. A “public street” is a street dedicated to public use and available to the public’s unrestricted use.
In Botetourt, there are some privately maintained streets that are not maintained by the department or the local governing body. There are also access easements that are created to serve lots created by family subdivisions or other lots created in the past under previous ordinances. Property owners should refer to a deed or plat to determine what responsibilities exist to maintain these streets or roads.
